Armagh businessman who engaged in sexual activity in presence of child to be sentenced

An Armagh businessman who intentionally engaged in a sexual activity in the presence of a child will be sentenced in May.

Brian McCauley, with an address of Jubilee Park in Armagh, pleaded guilty to the single charge of “intentionally engaging in a sexual activity for the purpose of obtaining sexual gratification when [complainant], a child under 13 years was present or in a place from which he could be observed and he knew or believed that she was aware or intended that she would be aware that he was so engaging”.

The offence occurred on March 29, last year. A single count of sexual communication with the same complainant, on the same date, was left on the books, not to be proceeded with.

The 48-year-old appeared before Newry Crown Court on Tuesday where His Honour Judge Ramsey KC ordered pre-sentence reports to be prepared ahead of sentencing on May 12 – the date which had originally been set aside for the beginning of his trial, having previously denied all the charges.

Addressing the defendant, Judge Ramsey, said: “We’re going to deal with the matter you pleaded guilty to. You’re going to be spoken to by Probation in the near future. It’s important that you engage fully with them, as I’m sure you will, and you give them as much detail as you can about your background, your circumstances, and circumstances around the offence to which you pleaded guilty so I have all the information before me when I come to sentence you.”

McCauley was released on bail until that date.
