A man accused of rape who has been “incommunicado” in custody since July has been released and had all charges against him dropped.
Jomon Joseph, with an address in Portmore Street, Portadown, appeared before Craigavon Magistrates’ Court via video link from Maghaberry Prison, where he has been held since his arrest for allegations of rape, possessing a knife and domestic abuse since July 2026.
The charges against the 34-year-old all relate to July 11, 2026 against a single, female alleged injured party.
While Joseph’s nationality was not outlined in court, it was previously mentioned that he is unable to speak English and has not been able to communicate with anyone for the duration of his time on remand.
In a previous hearing of Joseph’s case, the court heard that the complainant had withdrawn her statement.
Providing an update, the prosecution indicated that all charges against Joseph were to be withdrawn and a no prosecution decision had been entered.
District Judge Michael Ranaghan remarked: “It has now received the due expidition it should have been given from the start.”
An interpreter was called forward to inform Joseph of the decision.
All information was relayed to Joseph who appeared visibily grateful for the outcome. When asked if the defendant understood everything that was relayed to him the interpreter replied, “Yes, he is happy.”
