Man who assaulted his mother after argument over money jailed for four months

A Portadown man who assaulted his mother after having an argument about money has been sentenced to four months in prison.

The district judge told the 22-year-old: “It is still not clear how long it is going to take for the penny to drop for you to realise how important your family is to you.”

Kyle Elliott, of Clendinning Way, pleaded guilty to common assault, criminal damage and breach of a restraining order at Craigavon Magistrates’ Court, where he appeared via videolink from Maghaberry.

Defence solicitor John McAtamney stated: “He has spent nine weeks and three days in custody. Again this was an incident involving his mother.

“Most of the recent entries on his record involve her and the restraining order is in relation to her.”

Prosecution outlined that on November 11, at 8.40pm, police received a report from the injured party that she had been assaulted by her son, the defendant, and that he had damaged a table lamp.

She stated Elliott had become aggressive following an argument about money. He punched a table, damaging a lamp valued at £40.

When his mother advised him that she was going to call police, the defendant grabbed her wrist to prevent her from doing so.

Police observed that the injured party’s wrist appeared red and sore.

She informed officers that a restraining order was in place which prohibited Elliot being violent towards her or threatening violence.

This had also been put in place to prevent the defendant intimidating, harassing or pestering his mother.

Mr McAtamney said: “This all came out of an argument between him, his brother and his mother.

“Upon release he will have to report as homeless. Other than that he can return to his mother but she has said does not want him there.”

District Judge Steven Keown stated: “It is still not clear how long it is going to take for the penny to drop for you to realise how important your family is to you.

“You have one, two and three month sentences the last three times you have appeared before this court.”

Elliott was sentenced to four months in prison for these offences.
