Driver over three times drink limit weaving over road almost colliding with parked cars

The barrister said the defendant could not give an explanation as to why he did not provide an evidential sample as he had 'very little memory of what was going on in the police station'

A motorist who had a preliminary breath sample of more than three times the drink limit has been banned from driving for 16 months and fined £200.

Dwight William Cairns (55), with an address listed as Derryhale Road, admitted a charge of failing to provide an evidential breath sample.

Craigavon Magistrates’ Court was told police spotted the defendant’s vehicle weaving over the road almost colliding with parked vehicles in Portadown on August 8 this year.

When spoken to by police there was a strong smell of liquor and he had an alcohol in breath reading of 114 – the legal limit is 35.

At a police station he failed to provide an evidential sample.

A defence barrister said the defendant had been drinking and had not realised “how intoxicated he was” as he was on strong medication.

After being in “quite significant pain” he decided to drive.

The barrister said the defendant could not give an explanation as to why he did not provide an evidential sample as he had “very little memory of what was going on in the police station”.
