Illegal waste site outside Dungannon receives a Confiscation Order

A Confiscation Order totaling £295,827.38 has been granted by the Crown Court sitting at Dungannon today, 08 October 2025, against Mr. Gerard McGorry (58) of Sessiagh Scott Road, Dungannon relating to his environmental offending.

The Confiscation Order granted equates to the criminal benefit generated by Mr. McGorry from the illegal keeping and treating of controlled waste at a site located in the vicinity of Sessiagh Scott Road, Dungannon.

In 2019 officers of the Northern Ireland Environment Agency (NIEA) commenced an investigation in relation to the discovery of controlled waste on lands owned and controlled by Mr. McGorry at Sessiagh Scott Road. The waste discovered consisted mainly of plastics, metal, rubber, timber and foam.

Following the NIEA investigation Mr. McGorry pleaded guilty on 26 September 2022 to offences contrary to Article 4 of the Waste and Contaminated Land (NI) Order 1997. The criminal benefit generated from his offending was determined by the Court to be £295,827.38.

On the 09 December 2022 Mr. McGorry was sentenced to 8 months custody (suspended for 3 years) on all five counts listed in the in the indictment.

Today a Confiscation Order was granted by the Crown Court totaling £295,827.38 with the recoverable amount determined as £295,827.38, which equates to the value of assets held by Mr. McGorry to satisfy the Order.

Mr. McGorry was given 3 months to pay the Confiscation Order with a default term set at 5 years imprisonment in the event of non-payment.
