Crown court date for man accused of possessing BB gun with intent

A Co Down man accused of using a BB gun with intent to cause or threaten violence is to face the Crown Court later this year.

Jonathon Barton, with an address of The Forge, Kilkeel, appeared at Craigavon Magistrates’ Court, on Friday (June 24) for the purposes of a preliminary enquiry (PE) – the legal process during which a case is referred to the higher court.

While none of the facts were outlined in court, the 25-year-old faces a charge of possessing an imitation firearm, namely a BB gun, with intent to cause fear of violence.

It is alleged that the offence took place on September 11, last year.

Prosecution submitted that based on the papers before the court there was a prima facie case to answer.

Defence counsel made no contrary submissions.

District Judge Bernie Kelly, satisfied there was a prima facie case to answer, released the defendant on bail of £500 to reside at an approved address. Other conditions include a prohibition on consumption of alcohol and drugs.

Barton is to appear at Craigavon Crown Court for arraignment on September 27.
