Armagh man who engaged in sexual activity in presence of child handed 40 hours community service

An Armagh man – who ran a bouncy castle business for more than 20 years – has been handed a 40 hours of community service after he pleaded guilty to intentionally engaging in a sexual activity in the presence of a child.

Brian McCauley, of Jubilee Park in Armagh, pleaded guilty to the single charge of “intentionally engaging in a sexual activity for the purpose of obtaining sexual gratification when [complainant], a child under 13 years was present or in a place from which he could be observed and he knew or believed that she was aware or intended that she would be aware that he was so engaging”.

The offence occurred on March 29, last year. A single count of sexual communication with the same complainant, on the same date, was left on the books, not to be proceeded with.

The 48-year-old was sentenced this week before His Honour Judge Ramsey KC who also handed McCauley a two-year Probation Order.

The prosecution’s application for a Sexual Offences Prevention Order (SOPO) was refused, however, McCauley will be on the sex offenders register for a period of five years

The conditions of the Probation Order include  – but are not exhaustive; permanently residing at an approved address and must not leave to reside elsewhere without obtaining the prior approval of your supervising officer; must not reside (not even stay one night) in the same household as any child under the age of 18 without the prior approval of your supervising officer; must not undertake work or other organised activity – whether paid or unpaid – which will involve a person under the age of 18 without the prior approval of your supervising officer; must not access or use any social media account without the prior approval of your supervising officer; must not access any device with an internet capacity – including phones, laptops, palmtops, tablets, MP3 players and computers (but not restricted to the aforementioned) – other than a device which has the capacity to retain and display the history of your internet usage and the use of which has been approved by your supervising officer.
